You represent that you are at least 18 years of age and have the legal capacity to enter into binding contracts.

- Digital Wallet: Fund management, internal transfers
- AI Financial Assistant: Chat with specialized AI, personalized advice (OpenAI)
- Financial CRM: Contact management, leads, automation
- Gamification: Points system, achievements, challenges, rewards
- Financial Academy: Courses, articles, videos, certifications
- Fraud Detection: Monitoring, alerts, pattern analysis
- Automation: Automated savings, scheduled transfers
4. Eligibility and Requirements
- Minimum Age: Must be 18 years or older. Accounts of minors will be deleted immediately.
- Jurisdiction: Available in USA, EU, Latin America, and other countries (verify availability).
- Prohibitions: Cannot use XPlus Finance if on sanctions lists (OFAC, EU, UN), residing in embargoed country, or previously banned.
5. Registration and Account Security
Registration Information
Must provide: full name, valid email, secure password, date of birth, country of residence. All information must be truthful, accurate, and up-to-date.
Identity Verification (KYC)
We may require identity verification to comply with AML/KYC regulations, prevent fraud, and unlock premium features.
Account Security
- Keep password confidential and use a strong, unique password
- Enable two-factor authentication (2FA) - highly recommended
- Do not share account with third parties
- Notify us immediately of unauthorized access

- Platform Abuse: Multiple fake accounts, false information, identity impersonation, spam
- Unauthorized Commercial Use: Reselling access, competing with us, extracting data without permission
- Inappropriate Content: Offensive content, harassment, third-party rights violation
7. Financial Services
Bank Connection (Plaid)
- XPlus Finance does NOT store your bank credentials
- We only access read-only data (cannot move money)
- You can revoke access at any time
- Not all banks are supported
Market Data
- Data may be delayed up to 15-20 minutes
- We do not guarantee accuracy or timeliness of market data
- We do NOT execute trades - only track
Cryptocurrencies
- Currently we do NOT execute cryptocurrency transactions
- We only provide portfolio tracking
- Cryptocurrencies are extremely volatile - you can lose your entire investment
AI Assistant
- Uses OpenAI GPT - provides general information, NOT personalized advice
- AI can make mistakes - always verify important information
- We anonymize your data before sending to OpenAI
8. Fees and Payments
Subscription Plans
- Free Plan: Basic features, limited connections, with optional advertising
- Premium Plan (Paid): All unlimited features, no ads, priority support
- Professional Plan: For financial advisors, multi-client management, white label

Automatic Renewal: Subscriptions renew automatically. Notification 7 days prior.
Refund Policy
- 30-day guarantee: Full refund if you cancel within 30 days of first subscription
- Billing error: Full refund if we detect an error
- Service not delivered: Prorated refund if service down > 48 hours

9. Intellectual Property
We own: All source code, designs, "XPlus Finance" trademarks, logos, educational content, databases. Protected by copyright, trademark, and trade secrets.
Limited License to You: We grant you a limited, non-exclusive, non-transferable, revocable license for personal use. You may NOT copy, modify, distribute, reverse engineer, or use our trademarks without permission.
Your Content: You retain ownership of your financial data. By using the Platform, you grant us a license to store, process, and use aggregated/anonymized data for analytics. We do NOT sell your financial data to third parties.

12. Limitation of Liability
WE SHALL NOT BE LIABLE FOR:
- Loss of profits, revenue, data, business opportunities
- Investment decisions based on the Platform
- Errors in third-party market data
- Advice generated by AI
- Actions of third-party services (Plaid, Stripe, OpenAI, etc.)
- Force majeure (natural disasters, wars, pandemics, cyberattacks)
Maximum Liability: The amount you paid in the last 12 months, OR $100 USD, whichever is GREATER.
13. Indemnification
You agree to indemnify, defend, and hold harmless XPlus Finance from any claims, liability, damages, losses, costs, or expenses (including legal fees) arising from:
- Your use or misuse of the Platform
- Violation of these Terms
- Violation of third-party rights
- Content you upload
- Illegal activities
- Financial decisions
- Failure to protect credentials
14. Suspension and Termination
Termination by You
You can terminate your account at any time: Settings → Account → Delete Account
- Immediate access disabled
- 30-day grace period to recover account
- After 90 days: permanent deletion of personal data
- Financial data retained 7 years (legal requirement)
Suspension/Termination by Us
We may suspend or terminate your account for:
- Serious or repeated violation of these Terms
- Illegal activities, fraud, or malicious conduct
- Providing false information
- Abuse of services or support staff
- Non-payment (premium accounts)
- Inactive accounts (> 2 years, free accounts only)

- No Waiver: Non-exercise of rights does NOT constitute waiver
- Assignment: You may NOT assign; we may assign in case of merger/acquisition

- Force Majeure: We're not liable for circumstances beyond our control
